The Historic Landmarks Commission will meet next on November 13, 2006, in its offices in the Ratcliffe-Otterbourg House at 2100 Randolph Road, Charlotte, N.C.  The meeting shall commence at 6:00 p.m.  Anyone needing assistance should contact the Historic Landmarks Commission beforehand at 704-376-9115.

a.  Archives and History Review of prospective landmarks

Background information.  Within the last six months the content and tone of comment letters from the North Carolina Division of Archives and History regarding prospective historic landmarks has changed.  Heretofore the letters, which are advisory in nature, have generally supported designation and have advanced few questions about claims for special significance for prospective landmarks.  That is no longer true. 

As a general rule, except when properties appear to be substantially endangered, staff will not be bringing properties before the Commission until the comment letters have been received.  As a first step staff is bringing to your attention letters regarding properties the Commission has already recommended for designation but for which the joint public hearing has not been held.

a.  Application For A Certificate Of Appropriateness For The Home Federal Savings and Loan Building.

The Committee considered this issue and passed the following motion:

MR. SHURLEY PRESENTED A MOTION SECONDED BY MR. WEIS TO RECOMMEND TO THE HISTORIC LANDMARKS COMMISSION THAT THE APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS FOR THE HOME FEDERAL SAVINGS AND LOAN BUILDING, 139 SOUTH TRYON STREET, CHARLOTTE, N. C., BE APPROVED AS SUBMITTED. THE COMMITTEE APPROVED THE MOTION AS PRESENTED.

APPROVE: MR. BENSON, MR. SHURLEY, MR. WEIS AND MR. NORMAN OPPOSE: MR. ALSOP, MS. JOHNSON, AND MS. LEWIS

b.  Consideration Of Preservation Plan For The Coffee Cup Soda Grill.

Background:  At its October meeting the Commission deferred action on the Survey Committee's recommendation that the Coffee Cup Soda Grill be recommended for historic landmark designation.  The reason for this delay was to give the owner, Beazer Homes, Inc., the opportunity to meet with members of the Commission to devise a possible preservation solution for the subject property.  The details of the proposed solution were presented to the Design Review Committee, and the Committee passed the following motion.

MR. WEIS PRESENTED A MOTION SECONDED BY MR. SHURLEY TO RECOMMEND TO THE HISTORIC LANDMARKS COMMISSION THAT IT NOT ACCEPT THE PLANS PROPOSED BY BEAZER HOMES FOR THE COFFEE CUP SODA GRILL, 914 SOUTH CLARKSON STREET, CHARLOTTE, N. C. THE COMMITTEE APPROVED THE MOTION.

APPROVE: ALSOP, JOHNSON, LEWIS, SHURLEY, WEIS

OPPOSE: BENSON, NORMAN

Staff Recommendation:  Staff has found that the subject property does meet the requisite standards for special significance for prospective historic landmarks.  However, the Commission needs to take into account and be sensitive to the wishes of the owner, who is opposed to historic landmark designation.

The Commission passed the following motion in January 1999.  This is the current policy governing the actions of the Commission regarding recommending properties for historic landmark designation over owner opposition.

 
MR. MARTIN PRESENTED A SUBSTITUTE MOTION, SECONDED BY MR. WHITNEY, THAT THE HLC WILL BE SENSITIVE AND RESPECTFUL OF AN OWNER’S DESIRE REGARDING RECOMMENDATIONS FOR PROCESSING AN OWNER’S PROPERTY, BUT THAT THE HLC, AFTER DELIBERATE CONSIDERATION, WILL RECOMMEND THE PROCESSING OF PROPERTIES FOR HISTORIC DESIGNATION IF IT DEEMS THAT THE PROPERTY IS WORTHY OF CONSIDERATION FOR DESIGNATION IN ACCORDANCE WITH THE PREVAILING GUIDELINES. THE HLC UNANIMOUSLY APPROVED THE MOTION.
